Filing Requirements
First Information Report (FIR) or complaint under section 220 BNS is a must to commence criminal proceedings against husband or his relatives.
Who Can File a Complaint
Such a complaint can be made by the following persons:

Person aggrieved: The married woman herself

Immediate family: Her father, mother, brother, sister
�
Father's side: Father's brother or sister
�
Mother's side: Mother's brother or sister
�
Other relatives: With court's permission, any person related to such woman by blood, marriage or adoption
Court Permission Required
For relatives other than immediate family members and uncles/aunts, prior permission from the court is required before filing a complaint for cruelty under Section 85.
